Terms of Service: Digital Skills Assessment

These Terms of Service (“Terms”) govern your access to and use of the Digital Skills Assessment platform (“the Service”), operated by James Adams, acting as a sole trader under UK Law (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

The Service is a web-based assessment platform designed to evaluate digital competency levels. It maps learner performance against various UK awarding body frameworks, including BTEC, BCS, NCFE, City & Guilds, and OCNLR. The Service provides recommendations for training pathways based on a Functional Proficiency Score (FPS).

2. User Roles and Accounts

The Service utilises a multi-tier role-based access control (RBAC) system:

  • System Administrators: Responsible for global management, including the question bank, organisation creation, and system configuration.
  • Organisation Administrators: Designated users for a specific Customer who can manage their organisation's members and view all assessment data within that organisation.
  • Organisation Members: Users who can generate assessment links and view results only for learners they have specifically invited.
  • Assessment Takers (Learners): Anonymous users who access the Service via a unique token or link provided by an Organisation.

3. Assessment Credits and Quotas

  • Quotas: Use of the Service is limited by a quota of “Assessment Credits” assigned to each Organisation.
  • Usage: A credit is consumed when an assessment token is created.
  • Deletion: Deleting an assessment result does not restore a credit; the record remains for accounting purposes.
  • Token Expiry: Unless otherwise specified, individual assessment tokens expire 30 days after creation.

4. Acceptable Use

Users agree not to:

  • Bypass or attempt to bypass any security measures, including rate limiting enforced on public endpoints.
  • Scrape or systematically extract questions from the Question Builder or assessment pool.
  • Misrepresent their identity or use the Service for any fraudulent purpose.
  • Interfere with the strict data isolation (Tenant Isolation) designed to keep organisation data separate.

5. Data Privacy and Security

  • Data Controller: For data provided by Learners, the Organisation acts as the Data Controller, and we act as the Data Processor.
  • Data Isolation: The Service employs database-level Row Level Security (RLS) to ensure that Organisation data is siloed and inaccessible to other Customers.
  • Audit Logging: For security and accountability, we maintain an audit log of significant actions, including role changes, password resets, and data exports.
  • Learner Anonymity: Learners take assessments without creating a platform account; results are linked to an Organisation via a one-time token.

6. Intellectual Property

  • Platform Content: All software, algorithms (including the FPS scoring engine), and the question bank are the exclusive property of Digital Skills Assessment.
  • Reports: Learners and Organisations are granted a non-exclusive license to use and share the generated PDF reports for personal or educational placement purposes.

7. Disclaimers and Limitation of Liability

  • Recommendations Only: The Service provides automated placement recommendations based on user input. Final decisions regarding a learner's educational pathway remain the sole responsibility of the Organisation.
  • External Standards: While the Service aims to align with frameworks like BTEC and BCS, we do not guarantee that the assessment outcomes will match the results of official examinations from these bodies.
  • “As Is” Basis: The Service is provided on an “as is” and “as available” basis. We do not guarantee 100% uptime.

8. Termination

We reserve the right to deactivate any Organisation or User account that violates these Terms or exceeds its assigned assessment quota.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.
